STOP ATF ABUSES

In its most recent in a long series of abuses, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, has published the long-dreaded pistol stabilizing brace (PSB) ban in the Federal Register on January 31, meaning owners of AR-15-style pistols with PSBs have until May 31, 2023 to comply or risk prosecution for a 10-year, $250,000 federal felony.

Reversing its long-held position that braces were legal even under “incidental” use from the shoulder, the ATF is effectively thumbing its nose at gun owners; when comments to the Notice of Proposed Rulemaking overwhelmingly opposed the absurdly complex “Form 4999” it proposed to objectively calculate whether an AR-15 pistol was, in fact a “short-barreled rifle” (SBR) restricted by the 1934 National Firearms Act (NFA), it ditched the form and replaced it with a vague, arbitrary and utterly subjective “We’ll know it when we see it” approach guaranteed to subject thousands of gun owners to potential prosecution.

How best to fight ATF abuse?

The question became one of how best to fight the ruling. Although GRNC will likely join Gun Owners of America in litigation, the protracted and uncertain nature of public policy litigation generally makes it a last resort.

Congressional legislation such as Representative Matt Gaetz’ (R-FL) proposal to abolish the ATF and the Senate’s “Stop Harassing Owners of Rifles Today Act” or “SHORT Act,” are subject to filibuster in the Senate and are therefore destined for failure.

Accordingly, in coordination with GOA GRNC is pursuing action under the 1996 “Congressional Review Act” (CRA) which allows Congress to rescind agency rulemaking. Specifically, GRNC is pursuing a special joint resolution of disapproval of the rule.

To be honest, it’s a “Hail Mary.” But even if it fails, the joint resolution would raise public awareness of ATF abuses, put the agency on notice that its malfeasance will no longer be tolerated, and because the resolution can be discharged from committee and can avoid the Senate’s filibuster, could put legislators to a recorded vote on the issue.
