In its present form, Grass Roots North Carolina opposes Senate Bill 310 (“Criminal Law Changes”) because Section 1.(a) of the bill is overbroad and could subject lawful gun owners to felony prosecution and a permanent firearms disability under federal law.

GRNC understands that SB 310 is well-intentioned and that the Legislature is seeking to give prosecutors better tools to hold dangerous criminals accountable. We do not oppose that goal. What we cannot support is language that, as currently written, sweeps in ordinary, lawful conduct and imposes Class E felony consequences on gun owners who have done nothing wrong.

The Problem: What Section 1.(a) Actually Says

The new subsection (a1) of G.S. §14-34.1 — added on lines 16 through 20 of the first page — makes it a Class E felony for any person who “willfully or wantonly discharges” a firearm…

  • “in or on the property of another without the property owner’s permission,”
  • “on a public street or highway,” or
  • “at any public place where persons other than the person who discharged the weapon are present.”

On its face, this covers virtually every discharge of a firearm outside the owner’s private property — including lawful defensive use in a parking lot, a lawful target shot that crosses a property line, or a rural hunter who unintentionally fires near a public road. The conjunctive standard “willful or wanton” means that conduct satisfying either condition alone is sufficient — a far lower bar than the law historically requires.

A Class E felony conviction triggers a lifetime federal firearms prohibition under 18 U.S.C. § 922(g)(1). Gun owners convicted under subsection (a1) — even for an act that was not remotely dangerous — could permanently lose their right to keep and bear arms.

What GRNC Is Asking For

Preferred fix — Delete subsection (a1) entirely (lines 16–20, first page). The existing G.S. §14-34.1 already provides strong felony penalties for those who discharge a weapon into occupied property. The new subsection adds dangerous breadth without a corresponding public safety benefit that could not be achieved through targeted drafting.

Acceptable alternative — Change “willful or wanton” to “willful AND wanton” everywhere in lines 16 through 20 of the first page. Requiring both elements — that the discharge be willful and wanton — ensures the statute reaches persons who act in clear and conscious disregard for others’ safety, not lawful gun owners whose conduct is merely mischaracterized.

Either change preserves the Legislature’s intent to prosecute genuinely dangerous actors while protecting the rights of NC’s law-abiding gun owners.
