As hurricane Florence starts to affect North Carolina, we at GRNC would like to remind everyone to be safe and to make last minute preparations as soon as possible. Most of all, we hope everyone is out of harm’s way.
State of Emergency Gun Ban Background
GRNC’s sister entity, Rights Watch International, was a key plaintiff in the 2012 federal case that struck down NC’s unconstitutional provision that allowed for restrictions on lawful 2A activities during SOE declarations and soon thereafter, because of GRNC’s follow-up efforts, these restrictive laws were stricken from NC law unanimously in the NC Senate and with only one nay vote in the NC House and replaced by clear language allowing no 2A infringement during a SOE. |
Illegal SOE Gun Bans
Although our lawsuit in 2012 forced elected officials to recognize and respect the Second Amendment under all conditions, it came to the attention of GRNC volunteers that several towns were once again attempting a “state of emergency” gun ban due to hurricane Florence. This is unlawful and needed to be corrected.
GRNC’s Direct Action
GRNC would like its supporters to be aware that once these offenses were identified, GRNC’s legal counsel, its director of local affairs and other volunteers took immediate and direct action. Municipal leaders were contacted by phone and email, the law was cited, and it appears that these towns have updated their posts to remove the call for a gun ban. Indeed, it appears that GRNC communications have moved the needle and caused the municipalities of Leland, Carolina Beach and Roanoke Rapids to correct, appropriately modify, or remove their illegal SOE gun ban notices.
Please know that it is because GRNC volunteers have been rapidly responding to the illegal and offensive restrictions that we haven’t had a chance to publish an update until now — we’ve been acting, not tooting our horn. Unfortunately, our efforts have been hampered by the fact that the communities in question, and several of our volunteers for that matter, are in the path of the storm and therefore are likely preparing themselves. Therefore, we recognize that updates to the outdated SOE notices may not be priority #1 for municipal employees. That said, GRNC volunteers are pulling out the stops to correct the misinformed civil servants.
Help GRNC Watch for Offenses
If you come across illegal SOE Second Amendment violations, you are encouraged to email GRNC (https://www.grnc.org/contact) or leave a voicemail on the office phone (877-282-0939) and our volunteers will do their best to follow-up, although that may not be possible until after the oncoming storm subsides. GRNC volunteers will always make their best effort to see that lawful firearm owners are not restricted beyond what the law currently allows.
