GRNC lawsuit against
Wake County sheriff continues
[Raleigh] Yesterday, WNCN (CBS 17 in Raleigh) falsely reported that GRNC’s lawsuit against Wake County Sheriff Gerald Baker over his refusal to follow G.S. 14-404(f) by issuing NC pistol purchase permits within the requisite 14 days. Although Superior Court Judge Bryan Collins denied the temporary restraining order sought, he did not rule on the overall lawsuit, which continues.

Said GRNC’s lawyer, Jeff Dobson:
“While we were hopeful for an outcome that protected the Constitutional rights of North Carolinians, the Court has only addressed the restraining order and not the merits of the suit as a whole. Both Mrs. Assadi and GRNC plan to move forward with the lawsuit.
“Contrary to the Sheriff Baker's statement, Grassroots does have standing in this matter. An organization has standing as long as (a) its members would otherwise have standing to sue in their own right; (b) the interests it seeks to protect are germane to the organization’s purpose; and (c) neither the claim asserted, nor the relief requested, requires the participation of individual members in the lawsuit. 432 U.S. 333. GRNC meets all three prongs of that test.
