Redundancy, a Staple of Bureaucracy
Of course, we’ll all be contacting our elected servants to inform them of their pending mistake and encourage them not to make such an error. And when we do, it will probably be embarrassing for the bill’s legislative sponsors and supporters to learn that their own legislative body has already passed into law a bill with similar reach.
In NC’s ‘Domestic Violence Statutes (50B)’ you’ll find:
(h) Disposal of Firearms. – If the defendant does not file a motion requesting the return of any firearms, ammunition, or permits surrendered within the time period prescribed by this section, if the court determines that the defendant is precluded from regaining possession of any firearms, ammunition, or permits surrendered, or if the defendant or third-party owner fails to remit all fees owed for the storage of the firearms or ammunition within 30 days of the entry of the order granting the return of the firearms [click here to read more…]

Burning Cash: A Bureaucratic Virtue
But wait, there’s more. If you like the redundancy presented by H712, you’ll also love its ability to burn government assets, costing us all through the purposeful elimination of potential revenue. In its language regarding when and why to destroy a firearm, the bill sets up the false narrative that unless a gun has obvious trade-in value in purchasing firearms for the police, it has no value at all.
Also, the bill’s precepts ignore the fact that one man’s refuse is another’s treasure. Firearms that law enforcement may deem valueless, may be quite valuable to collectors and other enthusiasts. The bill essentially forces potential bags of money to be burned. Perhaps NC lawmakers just prefer to grab all their revenue from your paycheck and at the local cash registers where you ante up for Raleigh.
H712 is Anti-Gun
Clearly, there is an anti-gun bias built-in to H712, and surely that is the reason several of the sponsors are known, anti-gun politicians. Note that there are no similar rules for the destruction of confiscated automobiles, tools, jewelry, or any other property. If a gun does not seem to have trade-in value, law enforcement ought to turn it over to the state surplus agencies just like all the other property they dispose of. This bill is just an excuse for law enforcement to destroy perfectly good firearms (a phrase that likely sounds counterintuitive, perhaps absurd, to this bill’s sponsors).

Suggested Subject: “Oppose H712: A Redundant, Fiscally Irresponsible, Anti-gun Bill”
Dear Rules Committee Member:
I am writing today because I understand that Republicans on the Judiciary Committee failed to stop H712 and that the bill will soon be heard in the Rules Committee. It is disappointing and even shocking that a bill this redundant and wasteful, and worse, one sponsored by several anti-gun legislators, would be allowed to advance by members of the Republican Party. Judiciary Republicans have done this even after being admonished by their constituency to stop the bill. So now it’s up to you, and I must insist that you strongly oppose this bill.
There are already laws in place to deal with the storage or destruction of government-owned firearms, NC’s “Domestic Violence Statutes (50B),” for example. There is no reason that these existing laws, either directly or with the most minor of adjustments, can’t be used to handle the matters addressed by H712. Unfortunately, cumbersome redundancy seems to be a staple of bureaucracy, but I expect members of the Republican Party to work to eliminate it wherever it can be found. However, piling on the red tape is exactly what H712 does.
H712 would also set up a system where real government revenue is tossed in the shredder and it does so in a particularly anti-gun fashion—the wanton destruction of firearms. This is supported by the fact that there are no similar rules of disposal for confiscated automobiles, tools, jewelry, or any other property. If a gun does not seem to have trade-in value, law enforcement ought to turn it over to the state surplus agencies just like all the other property they dispose of.
I insist that you oppose H712, a redundant, wasteful, anti-gun bill. I will be monitoring your actions on this issue through alerts from Grass Roots North Carolina.
