GRNC Alert 8/25/20: Sheriff Baker dodge is too little, too late

 

Wake County & its sheriff continue to thumb nose at gun buyers

 
 

ALL NC residents need to get involved in stopping permit delays, 
 
regardless of where you live

Wake County Sheriff Gerald Baker finally reacted to our third lawsuit by  adding five people to the staff responsible for processing pistol permits.  While this paltry move is welcome, it was only because of our legal actions.

It says a lot that he only he only indicated willingness to comply after being sued three times, and after violating the consent order requiring him to begin issuing permits as required by law.
 
It also demonstrates what GRNC has said all along: That Sheriff Baker could have done more to issue purchase permits to the throngs of new gun buyers who have discovered that the police will not protect their families during the current civil unrest, but he chose not to. Sadly, thousands of North Carolinians have been denied their rights – and the ability to protect their families – until Baker decided he felt enough pressure to comply with the law.

Since the public can’t legally buy handguns without either a pistol purchase permit or a concealed handgun permit, both of which his office is delaying, he is denying them both their rights under the Second Amendment and the means to protect their families. Worse, he is doing so when municipalities – including Raleigh – are refusing to protect citizens against violent anarchists.
 
By all appearances, Baker’s default position to defy the law and refuse gun permits to lawful citizens is actually the result of his ideological predisposition to end private gun ownership. 

Unfortunately, Baker’s feigned compliance is too little, too late. He should immediately resign or, failing that, be removed.

“In what is now the third lawsuit filed against Wake County Sheriff Gerald Baker over his refusal to follow state law regarding issuing handgun permits, Grass Roots North Carolina intends to ensure citizens’ rights are respected. Sheriff Baker seems to think he is above the law. Grass Roots North Carolina intends to prove otherwise. Since Baker doesn’t seem to be getting the message, we will deliver it loud and clear. We are also holding Wake County responsible for its refusal to stop Baker’s continued malfeasance.”

Purchase permits are taking nearly two months to process, despite the fact that G.S. §14-404(f) requires purchase permits to be issued or denied in 14 days, further stipulating that permits may only be denied only for statutorily permissible reasons.


When informed of his non-compliance with G.S. §14-404(f), Baker’s attorney responded: “…the 14 days doesn’t start until ALL of the information needed to process an application has been provided or obtained.” Translated, Baker is saying: “The 14 days required for applications doesn’t start until we give you an appointment to let you finish the application, which we won’t. So bug off.”


It is unlawful for citizens to buy handguns without either a pistol purchase permit or concealed handgun permit from their county of residence, meaning that Baker’s actions are denying citizens’ constitutional rights not only to keep and bear arms, but to protect their families at a time of national crisis when personal safety is very much in question.


If even one lawful citizen of Wake County suffers violent predation while awaiting a delayed gun permit, I will hold each of you personally responsible. I will be monitoring your actions through Grass Roots North Carolina legislative alerts.
