GRNC Alert 5/3/21: Will Dems Be Last to Cling to Jim Crow?

We need people to show up on Wednesday at 9: 00 AM at the NC General Assembly 16 West Jones Street at the Printed Bills office where GRNC will have a table set up. You will be asked to go to legislators offices and tell them to repeal the racist, Jim Crow-era pistol purchase permit law that some sheriffs are using to obstruct handgun buyers.

“Misfire: How the North Carolina Pistol Purchase Permit System Misses the Mark of Constitutional Muster and Effectiveness”. That is the title of a paper published recently in UNC’s North Carolina Law Review. Beyond excoriating NC’s pistol purchase permit (PPP) law on the grounds of ineffectiveness (states without such laws experience handgun murder rates than state with them) and likely unconstitutionality, the paper made a surprising conclusion about potential racism in application of the law.
 

You probably know that the archaic, 1919 law is a vestige of the Jim Crow era, when it was used to deny gun ownership to blacks using its vague “good moral character” requirement. But did you know that even today there exist racial disparities in denial of permits?
 

Yup. Looking at Wake County alone, blacks are being denied permits roughly three times more often than whites (23.54% versus 8.37%, respectively), suggesting that racial disparity may continue even today. Translated, that means hundreds – perhaps even thousands – of minorities around the state might be denied the ability to protect their families.

 
So who is standing up for both gun owners and minorities?
 

Republicans, for starters. Given that at least three NC sheriffs are using the PPP system to obstruct handgun purchases by lawful North Carolinians, Republicans have introduced HB 398, HB 559 and SB 687 – all to repeal the PPP law.
 

Next are the sheriffs. The NC Sheriffs’ Association just reversed its position and now supports repealing the archaic, racist law.
 

And who is clinging to this racist law? Why, the ostensible “voice of equity,” of course. Yes, Democrat legislators are the only ones still supporting a Jim Crow law which even today denies minorities the ability to protect their families.

This is to call on you to join in a truly bipartisan gesture to get rid of an ineffectual and racist vestige of the Jim Crow era.   

UNC’s North Carolina Law Review found that states without such laws experience handgun murder rates than states with them.  While likely being unconstitutional, this law based on racism still exerts disparities in the application of the law.

The NC Sheriffs’ Association just reversed its position and has now joined with the Republicans in supporting the repeal of this racist, archaic law.

The fact is that people are safer when they can defend themselves and their families from harm.  This racist law endangers those who cannot obtain a means of self-defense.   It’s is time that we repealed this vestige of the Jim Crow past and ensure the safety of the people at the same time.

I strongly urge you to support the repeal of our archaic, racist, and obstructionist pistol purchase permit law. I will be monitoring this issue through Grass Roots North Carolina legislative alerts.
